1. Acceptance of Terms

By accessing or using SwapRidez, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using this platform.

2. Service Description

SwapRidez is a classified listing platform that facilitates connections between vehicle owners interested in exchanging vehicles. SwapRidez acts solely as an intermediary platform and is NOT a party to any transaction, agreement, or exchange between users. We do not verify, endorse, or guarantee any listings, users, or vehicles posted on the platform.

3. User Representations and Warranties

By posting a vehicle listing, you represent and warrant that:

• You are the legal owner of the vehicle or have explicit authorization from the owner
• The vehicle is free of all liens, loans, and encumbrances
• All information provided is accurate, current, and complete
• All images uploaded are authentic photographs of the actual vehicle
• You have the legal right to enter into a vehicle exchange agreement
• You are at least 18 years of age

4. Platform Disclaimer and Limitation of Liability

SWAPRIDEZ IS NOT RESPONSIBLE FOR USER-GENERATED CONTENT, INCLUDING FRAUDULENT, MISLEADING, OR INACCURATE LISTINGS.

SwapRidez expressly disclaims all liability for:

• The accuracy, completeness, or authenticity of any vehicle listing
• The condition, title status, or legal ownership of any vehicle
• Fraudulent listings, misrepresentations, or deceptive practices by users
• Any disputes, damages, losses, or injuries arising from vehicle exchanges
• User conduct, communications, or agreements made through the platform
• The use of false, stolen, or manipulated images in listings

Users engage in vehicle exchanges entirely at their own risk. SwapRidez makes no warranties, express or implied, regarding the platform or any listings.

5. Fraudulent Content and Law Enforcement Cooperation

Any user who posts fraudulent listings, uses images they do not own or have permission to use, misrepresents vehicle ownership, or engages in deceptive practices will be:

• Immediately and permanently banned from the platform
• Reported to the Federal Bureau of Investigation (FBI) Internet Crime Complaint Center (IC3)
• Reported to state and local law enforcement agencies
• Subject to civil and criminal prosecution under applicable federal and state laws

SwapRidez will fully cooperate with law enforcement investigations and will provide:

• User account information, including email addresses and IP addresses
• All uploaded images and listing content
• Communication records and transaction history
• Any other information requested by law enforcement through proper legal channels

6. Prohibited Conduct

Users are strictly prohibited from:

• Posting false, misleading, or fraudulent information
• Using images without proper authorization or ownership rights
• Listing vehicles you do not own or have authority to exchange
• Engaging in identity theft, impersonation, or fraud
• Harassing, threatening, or defrauding other users
• Using the platform to facilitate illegal activities
• Circumventing or attempting to circumvent platform security measures
• Scraping, data mining, or unauthorized automated access to the platform

7. User Due Diligence Requirements

Users are solely responsible for conducting appropriate due diligence before exchanging vehicles. SwapRidez strongly recommends:

• Meeting in person at a safe, public location
• Verifying government-issued identification of the other party
• Inspecting the vehicle thoroughly and obtaining a professional mechanical inspection
• Obtaining a vehicle history report (Carfax, AutoCheck, etc.)
• Verifying clear title and lien status through the Department of Motor Vehicles
• Consulting with legal counsel regarding exchange agreements and title transfer
• Ensuring compliance with all state and local laws regarding vehicle transfers

8. Intellectual Property Rights

By uploading content to SwapRidez, you grant SwapRidez a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute your content solely for the purpose of operating the platform. You retain all ownership rights to your content.

9. Indemnification

You agree to indemnify, defend, and hold harmless SwapRidez, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from: (a) your use of the platform; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any vehicle exchange you enter into through the platform.

10. Termination

SwapRidez reserves the right to suspend or terminate your access to the platform at any time, with or without cause, with or without notice, for any reason including violation of these Terms.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms or use of the platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

12. Modifications to Terms

SwapRidez reserves the right to modify these Terms at any time. Continued use of the platform after modifications constitutes acceptance of the updated Terms.
